Virginia Graeme Baker Pool and Spa Safety Act – Part 1

With pool season 2009 underway, the U.S. Consumer Product Safety Commission (CPSC) is educating the public on swimming pool and spa safety as well as enforcing the Virginia Graeme Baker Pool and Spa Safety Act that went into effect in December 2008. The main purpose of the Act is to improve the safety of swimming pools and spas in an effort to save the nearly 300 children under the age of 5 that drown each year.

The Act is in response to the 2002 drowning of a little girl named Virginia Baker when her foot became trapped in the force of a hot tub suction drain which held her underwater resulting in her death.

On December 20, 2008, all commercial/public swimming pools, wading pools, and spas are to be equipped with compliant drain covers and secondary anti-entrapment devices to prevent children from becoming trapped in the suction of a drain to be compliant with the Act. As many of the reported entrapment deaths occurred in residential swimming pools and spas, the CPSC encourages owners of residential swimming pools and spas to install compliant drain covers and anti-entrapment devices which are now available at pool and spa equipment retailers.
