			<content:encoded><![CDATA[<p>Tourists take heed: <a href="http://www.pciaa.net/LegTrack/web/NAIIPublications.nsf/lookupwebcontent/6020802F245C8F10862577650057EA9">visitors</a> to California&#8217;s capital may soon have to pay additional fees if they are involved in a car accident within the city limits. </p>
<p>Under the bill, the fee would be determined by the level of response necessary. Non-residents would be charged $435 for routine crashes (i.e., fender benders requiring only police response), while a crash requiring hazardous material cleanup or helicopter transport would yield a $2,000 fine. </p>
<p>The city capital approved the tax <a href="http://www.kcra.com/r/24334677/detail.html">Tuesday evening</a>, and it will now be forwarded to the full council. </p>
<p>Sacramento Deputy Fire Chief LLoyd Ogan stated the city could recover up to one million dollars each year if they start billing the the non-resident drivers&#8217; insurance companies for the recovery fee. </p>
<p>In some cases, motorists insurance policies would cover the tax, however this is not always the case—leaving some policyholders stuck with the bill. </p>
<p>&#8220;It is unfortunate that local governments are adversely affected by the deep recession. But charging accident victims is unwise public policy and unfair,&#8221; <a href="http://theinjurylawerdirectory.blogspot.com/2010/07/sacramento-considers-imposing-car-crash.html">Sam Sorich</a>, president of the Association of California Insurance Companies said in a statement. Sorich states that as cities continue to implement this tax (several fire departments in California already have such a fee in place) insurance rates will rise, or companies will write in clauses stating they won&#8217;t cover the fees. </p>
<p>Woodland, a suburb of Sacramento, is one such community that has instituted a recovery fee. Since June 2009, the Yolo County Grand Jury has raised questions regarding the legality of the tax, and has since found the tax does not appear to be producing its projected revenue. </p>
<p>While <a href="http://www.thevirginiacaraccidentguide.com/">Virginia</a> has not yet introduced any such tax, there are still things that drivers <a href="http://accidents.theparrishlawfirm.com/virginia-motor-vehicle-accident-injury-articles.html">should know</a> before speaking with their insurance companies after an accident. </p>
<p>For example, if the fee was assessed in the form of a ticket, and you received one while vacationing in California, would it follow you back home? <p>Preliminary findings show that the throttles were wide open, and brakes weren&#8217;t engaged at the time of crash, insiders told the <a href="http://online.wsj.com/article/SB10001424052748703834604575364871534435744.html?mod=googlenews_wsj">Wall Street Journal</a>. This suggests that some drivers who said their cars surged out of control were actually pressing the accelerator, though their intent was to hit the brakes. </p>

<p>Official findings haven&#8217;t yet been released by the National Highway Traffic Safety Administration. The agency received more than 3,000 complaints of sudden acceleration over the past decade. However, because data recorders can lose their information if disconnected from the car&#8217;s battery, the agency is focusing only on recent accidents. </p>
<p>Of 75 fatal crashes, the NHTSA has only been able to verify that ONE was caused by a problem in the vehicle. The NHTSA is expected to officially release study findings once a broader report is completed in conjunction with NASA. </p>
<p>&#8220;In spite of our investigations, we have not actually been able yet to find a defect&#8221; in electronic throttle-control systems, NHTSA&#8217;s associate enforcement administrator Daniel Smith told a panel. &#8220;We&#8217;re bound and determined that if it exists, we&#8217;re going to find it. But as yet, we haven&#8217;t found it.&#8221;</p>

			<content:encoded><![CDATA[<p>It&#8217;s a story that&#8217;s been circulating for years: girl drives car down dark, empty highway. Girl sees flashing lights—she&#8217;s being pulled over. But wait! Girl senses something is &#8220;off,&#8221; calls secret, unlisted police number, and is informed the car attempting to pull her over does not belong to the police. Girl drives away to safety and police later find the man driving the fake car to be a wanted serial killer. OBVIOUSLY NOT REAL. But if all rumors are based in fact, is there an unlisted dispatch number to call? And how can you tell if it&#8217;s an unmarked police car flagging you down?</p>
<p>If you are for a moment doubting this is an urban legend, take a time out and <a href="http://www.snopes.com/crime/warnings/fakecop.asp">click here</a>. It&#8217;s one of those things that is a mixture of fact and fiction. </p>
<p>While yes, some states do have emergency &#8220;notification numbers&#8221; motorists can call, they tend to <a href="http://www.911dispatch.com/911/mobilenumbers.html">differ by state.</a> For example, in Virginia, motorists are encouraged to call 911, or #77 to reach the Highway Patrol. Caveat: Virginia borders many different police districts. If you&#8217;re in a moving vehicle near state lines, who knows where the cell tower will connect you (though I should note, Maryland uses #77 as well)? This is the reason it&#8217;s been drilled into our heads from an early age: 9-1-1 emergency. <strong>You should dial 911 first in case of an emergency.</strong></p>
<p>On that note however, some cell phone providers or auto insurance providers do have roadside assistance numbers for non-emergency situations. Contact your provider and store them in your cell phone contacts. </p>
<p>Now, on to the <a href="http://autos.aol.com/gallery/undercover-cop-cars/">unmarked</a> car. Sure, there have been <a href="http://www.snopes.com/crime/warnings/fakecop.asp">reports</a> of criminals masquerading as law enforcement. But it&#8217;s extremely unlikely. If you are ever truly in doubt, you can call the 911 dispatcher to confirm as you are being pulled over, request to see the officer&#8217;s badge and photo ID, or request to be allowed to follow the officer back to the police station. While your safety is certainly a priority, remember to be extremely polite when you communicate these requests to the officer. </p>
<p>Unmarked cars will vary by state and police district. But usually, they will have additional mirrors, as well as extra lights installed. Try looking for antennae and dash-mounted radar equipment, as well. </p>
<p>If there&#8217;s one thing you do note, it&#8217;s that only police vehicles can use flashing blue lights. So if you see those, it&#8217;s time to start slowing down and <a href="http://dwiblog.theparrishlawfirm.com/what-to-do-when-pulled-over-for-speeding-in-virginia/">pulling over.</a> </p>

<p>If you do choose to put on your own display, make sure you a) check out your municipality&#8217;s rules regarding fireworks ( they may not be allowed within your city limits) and b) observe the following safety rules. </p>
<p><strong>Kids shouldn&#8217;t play with fireworks. </strong><br />
When is the last time you were talking to parents of your kids&#8217; friends and someone said &#8220;And then we gave the kids some weapons-grade explosives, and MAN did they have a BLAST.&#8221;<br />
Exactly. And if you choose to give them sparklers, make sure they are well-supervised. Sparklers can reach temperatures of 1,800 degrees Fahrenheit, which is hot enough to melt gold. <p><strong>Buy legal fireworks</strong><br />
&#8220;Legal&#8221; in this sense means that they have a label with the manufacturer&#8217;s name and ignition instructions. Illegal fireworks account for a fair amount of fireworks injuries. On this note, don&#8217;t try to make your own fireworks. </p>
<p><strong>Keep water and sand nearby</strong><br />
It&#8217;s like keeping a fire extinguisher near the kitchen. You will also want to soak all used fireworks in a bucket of water before throwing them in the trash can. </p>
<p><strong>Point fireworks away from homes</strong><br />
&#8230;and brush, leaves, and anything else that&#8217;s flammable. </p>
<p><strong>Think about your pets</strong><br />
You&#8217;ll want to keep track of any outdoor pets to make sure they don&#8217;t get in the way of any fireworks, but consider the indoor creatures as well. Animals have very sensitive ears, and can become scared and even attack if they perceive themselves to be in danger. Any animal bites legally need to be reported, and can affect your home insurance rates just as a fireworks mishap could, so be sure you keep the animals away. </p>
<p><strong>Know the first aid basics</strong><br />
There should be a first aid kit in every home anyway, but it&#8217;s worth repeating. If someone is injured by a firework, <em>immediately</em> go to a doctor or the hospital. </p>
<p>If it&#8217;s an eye injury caused by a firework, don&#8217;t allow the victim to touch or rub it, as this could cause more damage. Cut out the bottom of a paper cup, place it around the eye to protect it from further irritation, and seek medical attention. </p>
<p>If the firework burns someone, remove any fabric (clothing, etc) from the affected area and run cool (NOT COLD) water over it. Get to the doctor. </p>
<p>Fireworks are meant to be fun, and are a traditional part of American celebrations. Enjoy the holiday safely!</p>

			<content:encoded><![CDATA[<p>Last July, <a href="http://www.nvdaily.com/news/2010/06/trucker-sentenced-to-two-years-in-fatal-i-81-crash.php">Pawandeep Singh</a> of Reston was driving his Peterbilt tractor-trailer down I-81 through Shenadoah County. </p>
<p>When traffic backed up due to another crash on the road ahead, <a href="http://www.whsv.com/news/headlines/97010104.html">Singh</a> was caught not paying attention, and rear-ended the Honda ahead of him. The car, driven by a pair of brothers in their early twenties from Houston, Texas, was pushed underneath another tractor-trailer by the force of the impact, and all three vehicles caught fire. </p>
<p>On Wednesday June 23, Singh was plead guilty to two counts of reckless driving and was sentenced to 2 years behind bars, a $5,000 fine, and 1-year license revocation (as part of a plea deal, charges were reduced from involuntary manslaughter). </p>
<p>Our thoughts are with the family of the victims at this time. While the criminal part of the proceedings may be over for Singh, the impact is far from over for the family of <a href="http://www.whsv.com/news/headlines/51803447.html">Stone and William Weeks</a>, crash victims. </p>
<p>Since the crash happened in Virginia, it would be possible for the Weeks family to seek damages for the loss of these young men. <a href="http://www.theparrishlawfirm.com/virginia-wrongful-death-lawyer.html">Wrongful Death</a> cases can be very complicated, due to the emotional height and uniqueness of each situation. 			<content:encoded><![CDATA[<p>After a month of investigating, Chrysler is <a href="http://www.freep.com/article/20100604/BUSINESS01/100604037/1014/rss13">voluntarily recalling</a> 34,631 Dodge Caliber and 90 Jeep Compass vehicles in as a result of problems with sticking pedals. The National Highway Traffic and Safety Administration has been investigating the problem for about a month now, however no accidents linked to the vehicles have been reported. The vehicles being recalled are 2007 models.</p>
<p>The pedals were supplied by CTS and similar to the ones which triggered the <a href="http://blog.theparrishlawfirm.com/toyota-to-be-fined-16m-accused-of-knowingly-endangering-american-drivers-virginia-recall-attorney/">Toyota recall</a> earlier this year. </p>
<p>CTS experienced manufacturing problems between March and May of 2006, affecting some of the cars released. <a href="http://www.autoblog.com/2010/06/04/chrysler-recalls-nearly-35-000-vehicles-for-sticking-accelators/">According to Chrysler</a>, only about 1/3 of the recalled cars are actually expected to have problems. </p>

			<content:encoded><![CDATA[<p>Back in February, the Virginia Assembly voted to i<a href="http://weblogs.baltimoresun.com/news/traffic/2010/04/virginia_considering_higher_sp.html">ncrease the speed</a> limit on some of the state&#8217;s rural highways. </p>
<p>The Virginia Department of Transportation has yet to decide which roads will see the increase from 65 mph to 70 mph, though the law is set to take effect on July 1. It is expected that sections of <a href="http://www.whsv.com/news/headlines/94526324.html?ref=324">Highways 66 and 81</a> will be included. VDOT is currently reviewing crash and speed data to determine which roads would be suitable for an increase. </p>
<p>While the maximum speed on Virginia interstates has been 65 mph for about 20 years, a segment of I-85 was raised to 70 in 2007. Roads with a current speed limit of 60 mph will not be eligible for the change.</p>
<p>The measure has seen some <a href="http://www.nvdaily.com/news/2010/04/vdotstudies-highway-speed-limit-increases.php">opposition</a> from various community groups. The Shenadoah County Board of Supervisors unanimously approved a resolution against the proposal when it was passed in February, citing safety and fuel-efficiency concerns. </p>
<p>While opposition is bound to happen in any form of regulation change, it looks like this is one measure that will be going through. It&#8217;s important to remember, though, that drivers must travel at the posted speed limit until the changes are made official. Speeding in excess of 20 mph above the posted speed limit, or over 80 mph period, is considered <a href="http://dwiblog.theparrishlawfirm.com/reckless-driving-could-you-be-considered-guilty-woodbridge-reckless-driving-attorney/">Reckless Driving</a> in Virginia.</p>

			<content:encoded><![CDATA[<p>I really can&#8217;t say this enough: if you&#8217;re involved in any sort of investigation, it&#8217;s usually best to temporarily suspend any sort of social media account. This includes your Facebook, Twitter, etc. </p>
<p>At the very least, you&#8217;ll want to make it private. </p>
<p>An article in <a href="http://www.valawyersweekly.com">Virginia Lawyer&#8217;s Weekly</a> cited some pretty disturbing examples from attorneys Courtney Van Winkle and Tom Messersmith, both of Richmond, Virginia. </p>
<p>&#8220;One picture, one comment, can be taken out of context,&#8221; Van Winkle says. This does serious damage to a case. One defendant, who was drinking when an accident occurred, had a photo posted on his Facebook page of him holding up a beer can.</p>
<p>Whether or not that photo was from the night of the accident can leave an unwanted impression and do serious damage to a case. </p>
<p>If you were involved in a case, you wouldn&#8217;t make any sort of statement without first discussing it with your attorney. By posting a picture to Facebook or Tweeting, you are essentially making a recordable, archived statement to anyone who can read it. </p>
<p>Facebook settings can be tricky, and seem to change constantly. In fact, it seems we are always <a href="http://bit.ly/cXvjaQ">hearing stories</a> about errors causing information to be leaked. Even if you are POSITIVE your privacy settings are on, it&#8217;s best to err on the side of caution and not post anything questionable. </p>

			<content:encoded><![CDATA[<p>They&#8217;re designed to decrease major car accidents, but are they instead <strong>increasing</strong><em> the number of rear-end crashes? If you&#8217;re a Virginia driver who <em>hasn&#8217;t</em> been hearing about red light cameras lately, chances are you need to <a href="http://www.thenewspaper.com/news/31/3122.asp">read up</a>. </p>
<p>Last week, Governor Bob McDonnell signed a proposal into law that creates a new automated ticketing machine, an &#8220;airport business,&#8221; camera. This is just one part in a <a href="http://www.thetruthaboutcars.com/virginia-governor-kicks-off-massive-photo-enforcement-expansion/">series of legislation</a> designed to encourage the use of red light cameras. </p>
<p>HB 1292, which is set to take effect in July, was written to encourage local jurisdictions to deploy red light cameras. Previously, private photo enforcement firms couldn&#8217;t directly access confidential information from the Department of Motor Vehicle databases. Because the firms couldn&#8217;t access the info, the cost of automated ticketing was higher than the revenue cities could gain from it. The new law changes this however, making it much simpler for more cities to utilize red light cameras. </p>
<p>Red light cameras in Virginia have been a point of contention in the past. They were in use from 1995-2005, when the General Assembly banned them, under pressure from civil rights activists and presented with a results of a <a href="http://www.thenewspaper.com/news/18/1844.asp">Virginia Department of Transportation study</a> showing that the number accidents actually <em>increased</em> at intersections with red light cameras installed, as people tended to slam on their brakes. </p>
<p>While the General Assembly reinstated camera use in 2007, debate continues as to the effectiveness of the cameras in terms of accident prevention. </p>
<p>The Virginia DOT study did show that rear-end crashes increased 27% at intersections installed with cameras. However, the &#8220;angle crashes,&#8221; (when a car runs a red light and strikes another car at an angle) decreased 42%. </p>
<p>As Fairfax City Police Chief Rick Rappoport explained to the <a href="http://www.washingtonpost.com/wp-dyn/content/article/2009/02/18/AR2009021801108.html">Washington Post</a>, &#8220;In rear-end crashes, &#8220;people are slowing, they tend to be lesser-speed impacts, and the impact is on a part of cars that&#8217;s most designed for impacts.&#8221;</p>
<p>Rappoport commented further that he would be monitoring crash rates to ensure that the decrease in angle crashes wouldn&#8217;t be offset by the number of rear-end crashes. </p>
<p>Since HB1292 adds an additional degree of supervision from the state Transportation Department, any jurisdiction that wants to install the cameras must submit a detailed proposal to VDOT, and then wait for them to install the cameras. Rappoport doesn&#8217;t expect Fairfax City&#8217;s cameras to be fully operational until Fall 2010. </p>

			<content:encoded><![CDATA[<p>In Charlottesville on Monday, two bicyclist collided with vehicles in two separate <a href="http://www2.dailyprogress.com/cdp/news/local/article/bicycle_incidents_put_spotlight_on_safety/55163/">incidents</a>. <a href="http://www2.starexponent.com/cse/news/state_regional/article/bicyclist_dies_in_charlottesville_after_collision_with_city_truck/56131/">Matthew King</a> died in the hospital shortly after a 9 a.m. collision with a city truck. Sherwood Richers, victim in the other accident, was much luckier. </p>
<p>The short window of time between these two events draws attention to the issue of bike and pedestrian safety. </p>
<p>According to the <a href="http://www.nsc.org/Pages/Home.aspx">National Safety Council,</a> approximately 716 pedestrians were killed by in traffic accidents in 2008. The number of bicyclists injured in traffic increased by 21%, continuing the upward trend. The City of Charlottesville reports 17 bicycle wrecks and 35 pedestrian accidents since the beginning of 2009. </p>
<p>As warmer weather moves in and fuel costs rise, biking is bound to become a more popular transportation option. As a driver, be sure to pay particular attention to where bike lanes end and begin. </p>
<p>As a biker, there are a few extra steps you can take to increase your safety. </p>
<p><strong>1. Be careful riding at night. </strong><br />
Sherwood Richers (referenced above) was riding his bike down a dark street a bit before midnight when he was hit. </p>
<p>Invest in a front headlight. You may also want to consider wearing reflective gear. </p>
<p><strong>2. Don&#8217;t stop in the blind spot of cars. </strong><br />
It&#8217;s called a blind spot for a reason. If you&#8217;re riding on the road and come to a red light or stop sign, stop behind the car in front of you (unless you are in a separate lane). If you stop in the vehicle&#8217;s blind spot, only the most alert of drivers will recognize your presence. Besides, you wouldn&#8217;t try that in a car, would you? <a href="http://www.vdot.virginia.gov/programs/bk-laws.asp">Virginia law</a> states that bicycles must obey all traffic signs, signals, lights and markings. </p>
<p><strong>3. Wear something bright, even during the day</strong>.<br />
Let&#8217;s face it: you&#8217;re a lot smaller than most of the other things on the road. Make sure they can see you coming. </p>
<p><strong>4. Signal your turns.</strong><br />
You&#8217;re less likely to be hit if others on the road can predict your motions. To signal LEFT, point your left arm straight out. To signal RIGHT, point your right arm straight out. You may have learned to signal a right turn by bending your left arm, but most drivers have no idea what this means. </p>
<p><strong>5. Ditch the Blackberry.</strong><br />
You wouldn&#8217;t drive and text, so why would you try to <a href="http://blog.theparrishlawfirm.com/walking-and-texting-pedestrian-accidents-on-the-rise/">ride a bike</a> and do the same thing? </p>
<p><strong>6. Stay sober.</strong><br />
The Washington, D.C. Court of Appeals <a href="http://www.wjla.com/news/stories/0410/728882.html">recently ruled</a> that riding a bike IS operating a vehicle, and thus a biker could be charged with DUI/DWI. Virginia courts also have a broad definition of what constitutes operating a vehicle.</p>
